These Terms of Service ("Terms") are a binding agreement between you and GoGreen ("GoGreen," "we," "us," or "our"), a business operating out of Zambia. They govern your access to and use of this website located at gogreenapp.com, including the product survey hosted on it (together, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to them, do not use the Site.
The Site is a pre-launch information page for GoGreen, a product currently in development that is intended to help shop owners, growers, and everyday consumers track energy use and carbon footprint and identify affordable green alternatives. The Site describes the product, explains our development plans, and collects survey responses from prospective users. GoGreen is not yet a live, commercially available application, and nothing on the Site constitutes an offer to sell a finished product or service.
You must be at least 16 years old to use the Site or submit the survey. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
The Site includes a survey used to gather feedback and gauge interest in GoGreen. By submitting the survey, you confirm that:
We reserve the right, in our sole discretion, to disregard or delete any submission we reasonably believe to be spam, automated, fraudulent, or abusive.
Submitting the survey expresses interest only. It does not guarantee you access to GoGreen once it launches and does not create any obligation on our part to deliver a product by any particular date, in any particular form, or at all. We are building GoGreen based on the feedback we collect, and our plans, features, and timelines may change without notice.
The GoGreen name, the GoGreen logo, and all text, images, graphics, and design elements on the Site are owned by GoGreen or used under licence, and are protected by applicable intellectual property laws. Except as necessary to view the Site in a standard web browser, you may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.
You agree not to use the Site to: violate any applicable law or regulation; infringe the rights of any third party; transmit any virus, malware, or harmful code; scrape or harvest data from the Site by automated means without our consent; or attempt to gain unauthorised access to the Site or its underlying systems.
Nothing on the Site constitutes financial, legal, engineering, or professional sustainability advice. Any figures, ranges, projections, or examples referenced on the Site are provided for illustration only and should not be relied upon for decision-making.
The Site and the survey are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by applicable law, GoGreen and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or in connection with your access to or use of the Site, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold GoGreen harmless from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.
We may revise these Terms as the product and business develop. Material changes will be reflected by updating the effective date at the top of this page. Your continued use of the Site after a change takes effect constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law principles. You agree that the courts of Zambia shall have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms or your use of the Site.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
